The specific scope of any project is defined exclusively by the written proposal or contract signed by both parties prior to the start of work.
We reserve the right to decline any project request at our sole discretion, including requests that fall outside our service area, exceed our current capacity, or involve conditions that we determine present unreasonable risk.
Estimates provided by Simi Valley Sunrooms & Patios are based on information available at the time of the site visit and are subject to change if site conditions, material costs, or project scope change before or during construction. Estimates are not binding contracts.
A written contract or proposal signed by both parties constitutes the binding agreement for any project. The price stated in the signed contract is binding except where change orders are issued in writing and signed by both parties. Verbal modifications to scope or price are not binding.
If unforeseen conditions are discovered during the course of work - such as hidden structural issues, improper prior construction, or utility conflicts - we will notify you before proceeding and provide a written change order describing the additional scope and cost.
Project start dates are estimates based on permit processing times, material availability, and our current workload. We will communicate any significant delays as soon as they are known.
If you need to cancel a project after signing a contract, please notify us in writing as soon as possible. Cancellations after material orders have been placed or permits have been submitted may result in costs for which you are responsible, as outlined in your signed contract. Specific cancellation terms are stated in each individual project contract.
Payment terms are stated in each signed project contract. In general, we require a deposit before work begins, with additional payments tied to project milestones and a final payment upon substantial completion. Specific percentages and due dates are defined in your contract.
Late payments may be subject to a late fee as specified in your contract. We reserve the right to suspend work on a project if payments are not made in accordance with the agreed schedule. Resumption of work following a payment-related suspension is subject to our current availability.
We accept payment methods as specified in your contract. All amounts are in U.S. dollars.
We obtain all required building permits for projects under our contracts unless the contract explicitly states otherwise. Permit fees are either included in the contract price or billed as a pass-through cost, as stated in your contract. You are responsible for obtaining any HOA approvals or other non-governmental approvals required for your project, unless we have agreed in writing to handle them on your behalf.
We warrant our workmanship for a period stated in your signed contract. This warranty covers defects in labor and installation performed by our company. It does not cover damage caused by misuse, neglect, acts of nature, settlement of land not caused by our work, or modifications made by you or others after project completion.
Manufacturer warranties on materials, windows, doors, roofing systems, and other products are separate from our workmanship warranty and are governed by the terms of the respective manufacturers. We will assist in processing manufacturer warranty claims where reasonably possible.
Except as expressly stated in your signed contract, the Site and all information on it are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.
To the fullest extent permitted by applicable law, Simi Valley Sunrooms & Patios shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or from any services we provide. Our total liability to you for any claim arising from services we perform shall not exceed the total amount you paid us for the specific project to which the claim relates.
Nothing in these terms limits liability for personal injury or property damage caused by our negligence, or for any other liability that cannot be excluded by law.
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any way that could damage, disable, or impair the Site, or interfere with any other party's use of it. You may not attempt to gain unauthorized access to any part of the Site or its related systems.
The content on the Site - including text, images, and other materials - is owned by or licensed to Simi Valley Sunrooms & Patios and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our written permission.
If a dispute arises between you and Simi Valley Sunrooms & Patios relating to services provided, both parties agree to first attempt to resolve the dispute through good-faith negotiation. If negotiation is unsuccessful, the parties agree to attempt mediation before initiating any legal proceedings.
Any legal proceeding that cannot be resolved through negotiation or mediation shall be brought in the appropriate state or federal court located in Ventura County, California. Both parties consent to the personal jurisdiction of such courts.
These Terms and Conditions are governed by the laws of the State of California, without regard to conflict of law principles. Any claim or dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Ventura County, California.
We reserve the right to update these Terms and Conditions at any time. When we make changes, we will update the effective date at the top of this page.
